Description

Adopted Amendment to Unfair Competition Act prohibiting price parity clauses regulating online booking platforms

On 8 June 2022, the Swiss Parliament approved the amendment of Article 8a of the Federal Unfair Competition Act (UCA), which prevents online booking platforms for accommodation services from using general terms and conditions that restrict the pricing and supply of accommodation providers through parity clauses, availability or condition parity clauses. The use of parity clauses by online booking platforms will be subject to civil law sanctions. The Swiss Federal Council will now decide the date on which the new restrictions for online booking platforms will enter into force.
