On 23 April 2014, the Brazilian parliament adopted the Civil Rights Framework (Marco Civil da Internet, lei n° 12.965) for the Internet. The Law sets out a set of rules concerning data protection regulation. Particularly, the Law defines the users rights as the right to inviolability and confidentiality of a user’s intimate and private life, their online communications and their stored communications. Further, the Law grants the user the right to receive clear and complete information, to only have certain data processed with the user’s express consent and the right to deletion of personal data. Additionally, a user must be able to publicly access the usage policies and consumer protection and defence rules in consumer relations must be adequately applied. The Law emphasises that the right to privacy and freedom of expression are crucial to ensure the right of access to the internet.
