MICT closes public consultation on draft Data Protection Bill including cross-border data transfer regulation

On 30 November 2022, the Namibian Ministry of Information and Communication Technology (MICT) closed its public consultation on the draft Data Protection Bill including cross-border data transfer regulation. The Bill would make the transfer of personal data to processors or third parties abroad subject to a number of conditions. Specifically, the recipient would need to be subject to similar levels data protection regulations which provide an adequate level of protection for the personal data of data subjects. Further, the transfer would have to meet certain conditions of necessity and require the consent of the data subject. Cross-border data transfers would be subject to the Data Protection Supervisory Authority's supervision.
