Issued resolution for removal of false and defamatory content from digital platforms during elections

On 20 October 2022, the Brazilian Supreme Electoral Tribunal (TSE) approved a resolution to combat misinformation published on digital platforms that are considered to compromise the integrity of the presidential electoral process. The resolution empowers the President of the TSE to order digital platforms to immediately remove the URL, URI or URN containing false or defamatory news of presidential candidates under penalty of a fine of BRL 100.000 per hour of non-compliance. Further, content already determined to be disinformation can, if reproduced, be covered by the initial determination without requiring a new determination. The resolution also extends a ban on paid political advertising in the period shortly before and after the election to internet blogs, websites, and social media.
