Cofece announces investigation into app store practices (IO-005-2022)

On 30 September 2022, Mexico's Federal Economic Competition Commission (Cofece) announced an investigation into how mobile applications and other digital content are developed, distributed, and sold in the app store market. Specifically, Cofece is concerned about possible monopolistic practices like tied selling, price discrimination, or exclusivity agreements. Specifically, Cofece will examine the business models of app developers and app store payment mechanisms. The investigation was not initiated on the basis of an alleged violation of a particular party, although parties who are found to have committed alleged violations will be subject to further trials, which could result in sanctions such as injunctions and fines of up to 8% of income.
