On 22 June 2022, California Assembly Bill (AB) 2089 on mental health privacy was amended by the State Senate. The amended version of the Bill requires any entity that provides a digital mental health service, when working with a health care provider, to provide information regarding how to find data breaches reported on the internet website of the Attorney General. The previous version of the Bill instead required the notification of all known data breaches and CMIA violations in the past three years. The other primary provisions of the Bill, relating to the prohibition of sharing mental health application information, remain substantially unchanged.
