Introduction of Massachusetts Act relative to algorithmic accountability and bias prevention

On 29 July 2021, the Act relative to algorithmic accountability and bias prevention was introduced in the Massachusetts House. The Bill aims to prevent algorithmic bias and distinguishes between high-risk automated decision-making systems and high-risk information systems. In particular, the Bill would require entities to conduct a data protection impact assessment, a study that assesses the extent to which an information system protects the privacy and security of personal data that the system processes. In case of non-compliance, entities face a fine of USD 100'00 per breach, as well as other damages, including injunctive relief and civil penalties.
