Announced investigation into TikTok for alleged violations of the GDPR data transfer provisions

On 14 September 2021, the Irish Data Protection Commission (DPC) initiated an investigation into TikTok personal data being transferred outside the European Union. The investigation represents the second investigation opened into the company's data collection and processing practices. In its investigation, the DPC aims to determine if the data transfers by TikTok to China comply with the data transfer rules under the General Data Protection Regulation (GDPR). The DPC is legitimized to initiate such proceedings pursuant to section 110 of the Data Protection Act 2018.
