Adopted Guidelines on Data Export Security Assessment Declaration

On 31 August 2022, the Cyberspace Administration of China (CAC) published the Guidelines on the Data Export Security Assessment Declaration. The Guidelines provide guidance to data processors on filling out data export self-assessments under the Measures for Security Assessment of Data Exports which entered into force on 1 September 2022. Furthermore, the Guidelines contain a list of documents that data processors should provide to the authorities. The Guidelines also define data transfers abroad as (a) transfer or storage abroad of data collected in China; (b) making data stored in China accessible to entities abroad, including making it available for download and export; and (c) any other transfer act determined by the CAC.
