The German federal government adopts a draft law for the national implementation of the EU`s digital single market directive. The German law includes the copyright responsibility of upload platforms for the content uploaded by their users. In order to protect artistic freedom and social communication, it allows the use of copyrighted works in particular for the purposes of quotation, caricature, parody and pastiche. To avoid disproportionate blocking of corresponding uploads when using automated processes, the law contains special rules for public communication. Creators are to receive a direct remuneration claim against the platforms for licensed uses. The law also includes the new ancillary copyright of the press publisher as well as changes in copyright contract law.
