Opened consultation on Commercial Surveillance and Data Security Rulemaking

On 11 August 2022, the US Federal Trade Commission (FTC) opened a public consultation on its Advanced Notice of Proposed Rulemaking (ANPR) regarding Commercial Surveillance and Data Security. In particular, the FTC is seeking comments on whether the Commission should adopt new rules governing the collection, compilation, protection, use, analysis, and retention of consumer data by businesses. Particularly, the ANPR consultation involves the following topics: harms to consumers and children, costs and benefits of regulation, regulation of automated systems, algorithmic discrimination, consumer consent, transparency requirements for companies, and enforcement. The consultation will open 60 days after the publication of the ANPR in the Federal Register.
