California Privacy Protection Agency adopts opposition to American Data Privacy and Protection Act

On 28 July 2022, the California Privacy Protection Agency (CPPA) voted unanimously to oppose the American Data Privacy and Protection Act (ADPPA). According to the CPPA, the ADPPA in its current form would preempt existing state privacy regulations, including California state privacy legislation, the California Consumer Privacy Act of 2018 (CCPA). As a result, the CPPA finds that the ADPPA would weaken the privacy protection of Californians by substituting a weaker federal framework, undercutting the CCPA's "floor" for privacy protections, California's future capacity to strengthen protections by law and restricting the CPPA's supervisory authority. Furthermore, the CPPA stated that it would support an amendment to the Federal Bill which would provide a regulatory "floor" whereupon states themselves could enact stronger protection.
