Closed consultation on EDPB Guidelines on certification as a tool for transfers

On 30 September 2022, the European Data Protection Board (EDPB) closes the public consultation on the 07/2022 Guidelines on certification as a tool for transfers. The Guidelines complement the EDPB Guidelines 1/2018 on certification. Certification is a new instrument for the transfer of personal data to third countries in the lack of an adequacy agreement (Article 46(2)(f)). The main purpose of the Guidelines is to explain and provide practical guidance for the application of this transfer tool. The Guidelines describe the purpose and scope of the tool, provide implementation guidance on the accreditation requirements, list specific certification criteria regarding adequate safeguards, and explain binding and enforceable obligations to be considered.
