Brazil: ANDP issues evaluation of Whatsapp Privacy Policy (Technical Note No. 49/2022/CGF/ANDP)

On 6 May 2022, the Brazilian Data Protection Authority (ANDP) issued a "Technical Note" on the privacy standards of messenger application Whatsapp LLC and its respective tools Whatsapp, Whatsapp for Business, and Whatsapp for Business - API. The aim of the note is to evaluate whether Whatsapp's privacy policy is adequate for the Brazilian Data Protection Law standard. The issues that were analyzed are how sensitive data is processed, the legal bases of data processing, the terms and conditions, and security measures. The technical note also covers the handling of sensitive data of minors. Other technical notes will follow, especially on data transfer and sharing standards.
