Published FTC Guidance on Effective Breach Disclosures

On 20 May 2022, the Federal Trade Commission (FTC) published a guidance on effective breach disclosures in case of cybersecurity incidents. The guidance stresses the importance of effective breach detection and responses, highlighting measures to counter, prevent, or mitigate attacks, prevent and minimise harm to consumers, provide information, and enable post-breach remedial actions. Further, the guidance explained that the FTC Act may require disclosure from entities in order to comply with their legal obligations.
