Description

Adopted CNIL Cookie Walls Guidelines

On 16 May 2022, the French personal data protection authority /Commission nationale de l'informatique et des libertés (CNIL)), published guidelines on the legality of "cookie walls". Cookie walls refer to making access to a website's content conditional on accepting cookies, with the only alternative to users instead of accepting cookies is usually a paywall. The CNIL guidelines explain that this practice could affect users' freedom of consent and provide criteria for websites to assess the legality of cookie walls. The criteria include the offering of fair alternative means of access without consenting to cookies to users, the charging of reasonable prices for alternative paywalls, and the clear and explicit limiting of the use of cookies to enable a fair remuneration for the services offered.
