Competition and Markets Authority closes consultation on revised guidance on transparency and disclosure (CMA6)

On 22 May 2026, the Competition and Markets Authority (CMA) closes the consultation on the revised guidance on transparency and disclosure (CMA6). The revised guidance addresses parties subject to CMA proceedings across competition enforcement, merger control, market investigations, consumer enforcement, subsidy control and digital markets functions. The revised guidance would consolidate the CMA's general approach to transparency and disclosure in a single document by withdrawing the Competition Commission's guidance on disclosure of information in merger inquiries, market investigations and reviews of undertakings and orders (CC7), whose relevant content would be absorbed into the updated CMA6. The revised guidance would reflect the CMA's pace, predictability, proportionality and process framework, which guides the CMA's approach to conducting cases. The revised guidance would also update the CMA's approach to information requests to reflect pace, proportionality and efficiency considerations, expand guidance on disclosure methods in active cases, and clarify the respective roles of the Procedural Officer, Procedural Complaint Adjudicator and General Counsel in handling conduct complaints. Following the consultation, the CMA will publish a final version of the revised CMA6.
