Introduction of EARN IT ACT 2022 (S.3538)

On 31 January, 2022, the "Eliminating Abusive and Rampant Neglect of Interactive Technologies Act of 2022" (EARN IT ACT 2022) was re-introduced to Congress. The bill aims to to prevent online child sexual exploitation by creating a commission and removing immunity from provider liability in Section 230 of the Communications Decency Act. The bill aims to create a "National Commission on Online Child Sexual Exploitation Prevention" to develop standards for content moderation regarding child sexual exploitation for platform providers. In addition, the bill adds an exemption to Section 230 of the Communications Decency Act, removing the immunity from provider liability for platforms displaying child sexual exploitation content.
