On 27 February 2026, the Law implementing the Digital Services Act, including designating competent authorities, was adopted by the Parliament. The Law implements EU Regulation 2022/2065 (the Digital Services Act) into national law. The Law applies to all intermediary service providers operating in Portugal, including hosting services, online platforms, marketplaces, and search engines. It requires intermediaries to comply with orders to act against illegal content and to provide information about service recipients, and establishes administrative offences covering failures specific to each category of provider, including failures by hosting providers to act against illegal content, failures by online platforms to protect minors and ensure advertising transparency, and failures by online marketplaces to vet traders. It designates the National Communications Authority as the national Digital Services Coordinator, with the Media Regulatory Authority and the National Data Protection Commission assigned supervisory responsibility over specific advertising and data protection provisions. Providers are subject to administrative offences, with fines of up to 1% of annual worldwide turnover for less serious infringements and up to 6% for more serious ones, alongside periodic penalty payments of up to 5% of average daily turnover per day.
