Federal Trade Commission submitted advance notice of proposed rulemaking on online food delivery fees to Office of Information and Regulatory Affairs

On 10 April 2026, the Federal Trade Commission (FTC) submitted an advance notice of proposed rulemaking (ANPRM) concerning fees charged by online food delivery services to the Office of Information and Regulatory Affairs (OIRA) for review. OIRA classified the ANPRM as a “significant regulatory action” under Executive Order 12866, which sets out the framework for federal regulatory planning and review, as well as Executive Order 14215 on agency accountability. As a result, the ANPRM is subject to OIRA review prior to publication by the FTC.
