Switzerland: Federal Data Protection and Information Commissioner published guidance on use of cookies and similar online tracking technologies

On 31 March 2026, the Federal Data Protection and Information Commissioner (FDPIC) published guidance on the use of cookies and similar online tracking technologies. The guidance applies to website operators and data controllers deploying such technologies, as well as to internet users interacting with Swiss-based services. The guidance highlighted that under the Telecommunications Act and the Federal Act on Data Protection, operators must inform users of non-essential cookie use and provide a meaningful right to object, with explicit prior consent required where processing is unexpected, high-risk, or involves sensitive data. The guidance also offers practical guidance to users on managing cookie banners, configuring browser settings, and controlling mobile app permissions.
