On 30 March 2026, the State Gaming Commission opened a consultation on the regulation on responsible gaming practices, until 15 May 2026. The regulation would apply to all licensed gaming operators in New York State, including mobile sports wagering platforms, video lottery gaming agents, multi-jurisdictional account wagering providers, and lottery courier services. The regulation would prohibit all covered operators from using artificial intelligence to offer personalised promotions or wager suggestions to customers and would require mobile sports wagering licensees to designate a responsible gambling lead and maintain a list of at-risk patrons. It would also require conducting due diligence reviews when patrons meet defined behavioural thresholds, carrying out phased interventions up to and including account suspension and closure, and shielding at-risk patrons from direct marketing. It also requires preventing patrons from cancelling withdrawal requests within three days of submission and prohibiting operators from soliciting patrons to reverse pending withdrawals.
