Guatemala and United States adopted Agreement on Reciprocal Trade including prohibition of technology transfer requirements

On 30 January 2026, the governments of Guatemala and the United States signed the Guatemala-United States Agreement on Reciprocal Trade. Article 3.4 of the Agreement stipulates that Guatemala shall not impose conditions or enforce undertakings requiring United States persons to transfer or provide access to specific technologies, production processes, source code, or proprietary knowledge as a condition for doing business. However, the Agreement allows Guatemalan regulatory or judicial authorities to require the preservation and disclosure of source code or algorithms for specific investigations, provided that safeguards against unauthorised disclosure are in place.
