United States and Chinese Taipei signed Agreement on Reciprocal Trade including technology transfer requirements

On 12 February 2026, the United States and Chinese Taipei signed the Agreement on Reciprocal Trade including provisions on technology transfer under the auspices of the American Institute in Taiwan (AIT) and the Taipei Economic and Cultural Representative Office (TECRO) in the United States. Article 4.4 prohibits the Chinese Taipei from requiring US persons in its territory to transfer or provide access to technology, source code, or proprietary knowledge as a condition for doing business. However, a regulatory or judicial authority may require the preservation and availability of software source code or algorithms for specific investigations or judicial proceedings, provided that safeguards against unauthorised disclosure are maintained.
