Introduction of SMART Copyright Act of 2022 in US Senate

On 17 March 2022, the Strengthening Measures to Advance Rights Technologies (SMART) Copyright Act of 2022 was introduced in the United States Senate by Senators Thom Tillis (R-NC) and Patrick Leahy (D-VT). The Bill aims to enhance online copyright protection by amending the Digital Millenium Copyright Act. The Bill expands the definition of “standard technical measures” (STM) to include technical measures created for specific industries, e.g. music or movies. Furthermore, the Bill would introduce a new liability for hosting providers regarding copyright violations, which increases with repeat offences.
