On 25 March 2026, the Fair Trade Commission (KFTC) opened a consultation on the proposed amendment to the Enforcement Decree of the Act on Fair Labelling and Advertising, until 4 May 2026. The amendment forms part of the KFTC Penalty Surcharge System Improvement announced on 30 December 2025 and targets the treatment of repeated violations. Under the proposed changes, the look-back period for establishing repeat infringement would be extended from three to five years, the aggravation threshold would be reduced to a single prior violation, and the maximum aggravation rate would be raised from 50/100 to 100/100. The amendment is scheduled to enter into force on 1 July 2026, with transitional provisions stipulating that previous provisions shall apply to violations concluded prior to that date.
