Decree No. 2026-196 on the rental of furnished tourist accommodations entered into force

On 21 March 2026, Decree No. 2026-196 entered into force, regulating the transmission of activity data from rental intermediaries to government agencies. The decree designates the Directorate-General for Enterprises as the single public body responsible for collecting and making this data available. Rental intermediaries, including digital rental platforms, must electronically transmit specific data, including the registration number of the accommodation, the URL of the listing, the precise address, and the total number of rental days. The frequency of transmission is set at three months for micro and small enterprises with fewer than 4'250 monthly listings, and one month for all other intermediaries. The body retains this data for the year of receipt and the subsequent year. Municipalities requesting access must provide documentation regarding their local authorisation and registration procedures. Additionally, the Directorate-General for Enterprises is required to publish regularly updated lists of participating municipalities and aggregated statistical data for each department or region. This data includes the total number of rented accommodations and a breakdown of primary versus non-primary residences. The decree was issued pursuant to Article 43 of Law no. 2024-449, aimed at securing and regulating the digital space.
