Senator released draft of TRUMP AMERICA AI Act including age verification requirement

On 18 March 2026, a United States Senator released a discussion draft of The Republic Unifying Meritocratic Performance Advancing Machine intelligence by Eliminating Regulatory Interstate Chaos Across American Industry Act. Section 503 would require covered entities to mandate user account creation before granting access to an AI chatbot, to freeze all existing accounts on the effective date of the Act and require users to provide verifiable age data before restoring account functionality, and to verify the age of all new account holders using a reasonable age verification process. Covered entities would further be required to periodically re-verify previously verified accounts. Section 504 would prohibit minors, once identified through the age verification process under Section 503, from accessing any AI companion owned, operated, or made available by a covered entity. Sections 413 and 414 would impose safeguards and disclosure obligations on covered platforms with respect to users the platform knows to be minors, including applying default protective settings and providing parental tools, without imposing a separate age verification duty. Section 417 would direct the Secretary of Commerce, in coordination with the Federal Communications Commission and the Federal Trade Commission (FTC), to conduct a study on technologically feasible methods for age verification at the device or operating system level, with a report to the Senate Committee on Commerce, Science, and Transportation and the House Committee on Energy and Commerce due not later than 1 year after enactment.
