Personal Information Protection Commission closes consultation on Partial Amendment to the Enforcement Decree of the Personal Information Protection Act

On 27 April 2026, the Personal Information Protection Commission (PIPC) opened a consultation on the Partial Amendment to the Enforcement Decree of the Personal Information Protection Act. The amendment would revise Article 60-2(1) to redefine the total revenue basis for administrative fine calculation under the Personal Information Protection Act. The existing basis, the three-year annual average revenue preceding the violation year, would be replaced with the greater of either the revenue of the single business year immediately preceding the violation year or the three-year annual average revenue preceding the violation year. Furthermore, the amendment would introduce a new provision granting the PIPC discretion to withhold the full or partial application of fine reductions at the first and second adjustment stages where a violation is classified as extremely serious.
