Description

Korea Fair Trade Commission closes consultation on Enforcement Decree of the Act on Consumer Protection in Electronic Commerce (Law No. 21312) including user review disclosure requirement

On 20 April 2026, the Korea Fair Trade Commission (KFTC) closes the public consultation on proposed amendments to the Enforcement Decree of the Act on Consumer Protection in Electronic Commerce (Law No. 21312). The amendments follow the Act promulgated on 20 January 2026. The amendments apply to e-commerce operators and mail-order businesses that publish consumer reviews. Under the proposed Article 27-3, such businesses would be required to display information about their consumer review practices on the first screen where reviews appear. The required disclosures would cover, firstly, the criteria for who is authorised to write reviews, secondly, the period for which reviews remain posted, thirdly, the criteria for ratings and their consequences, and fourthly, the criteria for deletion and the procedure for contesting a deletion. Where space on the first screen is insufficient, the disclosure may appear on a directly linked page. The Decree would also establish business suspension penalties for violations of the review disclosure obligation under Article 21-4 of the Act, set at 3 months for a first violation, 6 months for a second violation, and 12 months for a third violation. The Decree would enter into force on 21 July 2026.
