On 11 February 2026, the Bill regulating commercial relations between e-commerce platforms and partner sellers (PL 484/2026) was introduced to the Chamber of Deputies. The Bill establishes standards for the protection of free enterprise and competition in relations between Marketplaces and Partner Sellers. It defines Marketplaces as e-commerce platforms acting as intermediaries between sellers and consumers, and Partner Sellers as natural or legal persons using Marketplaces to offer goods or services to end consumers. Marketplaces are required to present, clearly and objectively, the criteria determining all fees, commissions, and charges on sales. Unilateral amendments to terms of use, contracts, or commission schedules that increase costs for a Partner Seller are prohibited without a minimum of 90 days' prior individual notice and a clear statement of reasons. During that notice period, the Partner Seller retains the right to cease activities and withdraw listings without penalties, with previous commercial conditions maintained until effective termination. Prohibited abusive practices include fixed per-item fees exceeding 10% of total product value, conditioning platform access on the purchase of accessory services, offering fee exemptions or significant reductions followed by arbitrary price increases, and offering commercial benefits conditioned on increases to fees, commissions or any charges on sales. Marketplaces may offer a differentiated reduced-rate regime for Individual Micro-Entrepreneurs and Micro-Enterprises.
