Bill establishing minimum age of 16 for social media accounts and restricting commercial exposure of minors (PL 29/2026) was introduced to Chamber of Deputies

On 02 February 2026, Bill No. 29/2026 to prohibit individuals under 16 years of age from creating or maintaining accounts on social media platforms was introduced to the Chamber of Deputies. The Bill would require platforms to adopt reasonable and proportionate age verification measures, as specified by implementing regulation, to prevent underage users from holding accounts. Any data collected for age verification must be used exclusively for that purpose, comply with the General Data Protection Law, and be deleted immediately after verification. The proposal also prohibits parents or legal guardians from commercially exposing images, videos, or personal information of minors under 16 on social media accounts under their control. Non-compliant platforms would be subject to administrative sanctions imposed by the National Data Protection Authority (ANPD) and other competent bodies, including warnings, fines, public disclosure of violations, suspension of data-processing activities, and partial or total prohibition of activities in Brazil. In addition, the Bill would establish the National Council for Monitoring and Prevention of Violence in the Digital Environment (CONAMPREV) to periodically assess and monitor the safety of social networks.
