Legal Framework for algorithmic management of work on digital platforms (7238-D-2025) including worker monitoring regulation introduced to National Congress

On 6 February 2026, the Legal Framework for the Algorithmic Management of Work on Digital Platforms (7238-D-2025) was introduced to the Argentine National Congress. The Bill would apply to digital platform companies operating in Argentina that intermediate delivery, messaging, distribution, or passenger transport services. The Bill would regulate the use of algorithmic systems for task allocation, performance evaluation, suspension, and deactivation of workers. The Bill would require platforms to provide workers with information on the variables and metrics used for task assignment, pricing, and performance scoring. The Bill would prohibit the collection and processing of personal data unrelated to work activities, including private conversations or emotional or psychological information, and would restrict data processing when workers are not connected to the platform. The Bill would grant workers the right to request meaningful human review of automated decisions affecting access to work, income, or account status. The Bill would also establish a right to disconnect without penalisation. In addition, the Bill would create the National Registry of Digital Platforms and the National Council of Digital Platforms to supervise documentation, auditing, and oversight of algorithmic systems.
