On 9 February 2026, Presidential Provisional Measure No. 1.317-A was approved by the Chamber of Deputies in the form of a Conversion Bill (No. 13/2025). The Measure amends the General Data Protection Law (Law No. 13.709 of 14 August 2018) to formally establish the National Data Protection Agency (ANPD) as a special autonomous agency linked to the Ministry of Justice and Public Security, granting it functional, technical, decisional, administrative, and financial autonomy. The Measure further amends Law No. 10.871 of 20 May 2004 to create the Career of Data Protection Regulation and Inspection, introducing senior-level Specialist in Data Protection Regulation positions with regulatory and supervisory powers, including the authority to order the closure of establishments, seize goods, and request police assistance in the exercise of inspection functions. It converts 797 vacant public service positions into 200 Specialist positions and additional commissioned posts and establishes new executive functions within the ANPD structure. Additional amendments integrate the ANPD into Law No. 9.008 of 21 March 1995, providing representation on the National Consumer Defence Council, and adjust remuneration and institutional provisions under Laws No. 11.890 of 24 December 2008, No. 13.326 of 29 July 2016, No. 13.848 of 25 June 2019, and No. 14.600 of 19 June 2023. The Measure also establishes that the Digital Statute of the Child and Adolescent (Law No. 15.211) enters into force on 17 March 2026. The ANPD must publish a plan to adapt its internal regulations within 30 days of the publication of its new regimental structure. The Provisional Measure requires approval by the Federal Senate within the constitutional deadline to be converted into permanent law.
