Securities and Exchange Commission issued order extending remedy deadline for KuCoin's capital maintenance deficiency

On 16 February 2026, the Securities and Exchange Commission Board of Thailand (SEC) issued an order to extend the deadline for ERX Co., Ltd. (operating as KuCoin) to remedy its capital maintenance deficiency until 30 March 2026. Under Section 35(1) of the Emergency Decree on Digital Asset Businesses, the SEC approved the extension as requested by KuCoin and acknowledged progress on board governance remediation, including plans to appoint replacement directors in line with regulatory requirements. It was stated that the SEC will continue close supervision, including daily monitoring of client asset reports, until full compliance is achieved.
