On 9 February 2026, the Ministry of Science and Technology opened a consultation on Decree No. 2026/ND-CP implementing the Law on AI, which establishes design requirements for labelling AI-generated audio, image, and video content. Article 18 requires suppliers to integrate metadata on content origin and system signatures, apply watermarks resistant to removal, incorporate optional user interface warnings, and maintain impact history records. Systems must have built-in marking capabilities before market entry and employ anti-tampering measures. Open-source model providers must offer content detection mechanisms and free authentication tools, while use policies must prohibit interference with identification marks. Article 19 mandates notifications and labels for AI-generated content made public that could cause confusion, with labels placed clearly at fixed positions. Simulated content depicting real people or events must be easily distinguishable from reality. Labelling requirements specify symbols in high contrast for images, verbal notices for audio, and screen corner displays for video, with minimum duration requirements. Cinematic and artistic works may follow adapted labelling that does not obstruct enjoyment as long as the labelling meets minimum requirements. Intermediary platforms must display lawfully provided labels but bear no obligation to actively identify AI-generated content. The Ministry of Science and Technology will issue implementation guidance ensuring feasibility without creating additional obligations or procedures.
