Vietnam: Ministry of Science and Technology opened consultation on Decree No. 2026/ND-CP implementing Law on Artificial Intelligence including local operations requirement

On 9 February 2026, the Ministry of Science and Technology opened a consultation on Decree No. 2026/ND-CP implementing the Law on AI, which establishes local operations requirements for foreign AI system providers. Article 17 requires suppliers of artificial intelligence systems with foreign elements that supply, distribute, or permit system use in Vietnam to maintain a lawful point of contact within the country. This local contact must fulfil obligations to coordinate with authorities, provide information, and offer explanations upon lawful requests from competent state agencies. The requirement ensures foreign providers can be reached for accountability and transparency purposes under the Decree's provisions. The Ministry of Science and Technology will issue implementation guidance focused on simplicity and feasibility without creating new risk criteria, pre-inspection procedures, periodic reporting obligations, or requirements exceeding the Decree's provisions.
