Ministry of Science and Technology opened consultation on Decree No. 2026/ND-CP implementing Law on Artificial Intelligence including public procurement access

On 9 February 2026, the Ministry of Science and Technology published Decree No. 2026/ND-CP implementing the Law on Artificial Intelligence including public procurement provisions. Article 23 mandates state agencies conduct impact assessments before deploying high-risk AI systems, those supporting administrative decisions affecting rights, systems managing public resources, or those serving large populations. Assessment reports must include system descriptions, risk analysis covering human rights and bias, control measures, and monitoring plans. Reports must also include other measures to control and minimise risk, including technical and organisational measures as well as measures to protect the legitimate rights and interests of both individuals and organisations. Reports require approval at least 30 days before deployment with public consultation, periodic review every two years (or when there is a significant change), and appraisal by the Ministry of Science and Technology for ministerial-level industries or the Department of Science and Technology for local deployments. Reports must be published online within 15 days of approval and submitted to the Ministry for central monitoring, with system suspension for non-compliance. Article 39 specifies mastery of artificial intelligence is to be supported through public procurement.
