On 9 February 2026, the Ministry of Science and Technology opened a consultation on Decree No. 2026/ND-CP implementing the Law on AI. Article 16 establishes that transparency and labelling obligations must be balanced against the protection of rights and technical capabilities, serving as the foundational principle for all specific compliance requirements detailed later in the chapter. Article 29 requires organisations conducting tests to publicly communicate risks through mass media and directly to relevant parties, ensuring information about products is accurate, complete, and truthful. Testing entities must secure voluntary participation from users who have been clearly informed of the nature, objectives, and risks, and participants retain the right to withdraw at any time without explanation through a simple process. Organisations must maintain human intervention capabilities over AI system predictions, proposals, or decisions. A data processing procedure must be established that monitors high risks to data subjects' rights, with all personal data deleted upon test completion.
