Denmark: Ministry of Culture closes consultation on Bill amending Copyright Act introducing performance protection and protection against digitally generated imitations (2025/0654/DK)

Description

Ministry of Culture closes consultation on Bill amending Copyright Act introducing performance protection and protection against digitally generated imitations (2025/0654/DK)

On 21 August 2025, the Danish Ministry of Culture closed its public consultation on a draft Bill amending the Copyright Act, introducing performance protection and protection against digitally generated imitations (2025/0654/DK). The proposal introduces two new protections into Danish copyright law. It establishes a general protection against the sharing of realistic digitally generated imitations of personal characteristics, such as appearance and voice, without consent. It also introduces a specific imitation protection for performing artists and entertainers against the sharing of realistic digitally generated imitations of their performances or artistic acts without consent. To enable protection against such imitations, the Bill proposes the creation of a distinct performance protection right granting entertainers protection equivalent to that afforded to performing artists, including for performances that are not performances of literary or artistic works. The Bill is expected to enter into force on 31 March 2026.
