On 10 February 2026, the European Data Protection Board (EDPB) and the European Data Protection Supervisor (EDPS) adopted a joint opinion on the proposal for a Regulation as regards the simplification of the digital legislative framework (Digital Omnibus). The EDPB and EDPS acknowledge the Proposal’s objectives to streamline compliance, enhance individuals’ rights, and support innovation, as well as aspects that may contribute to greater harmonisation, legal certainty, and reduced administrative burden, including provisions on scientific research, data breach notifications, and biometric verification. The EDPB and EDPS express concerns regarding proposed changes to the definition of personal data and the use of implementing acts for pseudonymised data, which may restrict the scope of personal data, create legal uncertainty, and affect the protection of individuals’ rights. The EDPB and EDPS also noted the absence of a full impact assessment and emphasised the need to ensure clarity and consistency in the application of the General Data Protection Regulation (GDPR).
