On 2 February 2026, the Data (Use and Access) Act 2025 (Consequential Amendments and Transitional Provision) Regulations 2026 were laid in draft before the House of Commons and the House of Lords under sections 139(5) and 140(2) and (4) of the Data (Use and Access) Act 2025. The draft Regulations provide for consequential amendments and transitional provisions arising from sections 117, 118, and 119 of the Data (Use and Access) Act 2025, including the establishment of the Information Commission, the abolition of the office of Information Commissioner, and the transfer of statutory functions to the Information Commission. They amend primary and subordinate legislation across the United Kingdom to replace statutory references to the Information Commissioner with references to the Information Commission, to adjust associated powers, duties, procedures, governance arrangements, appeals, and enforcement provisions, and to align related instruments accordingly. The Regulations also set commencement rules linking individual amendments to the staged commencement of provisions of the Data (Use and Access) Act 2025 and include a transitional provision relating to the first Chair of the Information Commission. The Regulations are subject to the draft affirmative procedure, requiring approval by resolution of each House before they may be made.
