Adopted amendment to French Code of Consumers introducing cybersecurity audit for digital platforms

The National Assembly and the Senate adopted the amendment to the French Code of Consumers introducing a cybersecurity audit requirement for digital platforms. In particular, the law targets the operators of "online platforms", defined as any legal person offering an online public communication service based on the algorithmic classification of third party content or the connection of several parties selling goods or exchanging content and providers of interpersonal communication services not based on a numbering system, whose activity exceeds a threshold established by decree. Such operators must conduct a cybersecurity audit concerning data security and localization. In particular, the audit shall be carried out by audit service providers licensed by the National Agency for Information Systems Security and its results shall be presented to the consumers in a comprehensible way, also using a colour information system. The amendment will enter into full force on 1 October 2023.
