European Union and India concluded negotiations for a Free Trade Agreement including user rights

On 27 January 2026, the European Union (EU) and India concluded negotiations for a Free Trade Agreement (FTA). The agreement contains a digital trade chapter that includes specific rules on online consumer protection. The chapter requires parties to adopt or maintain measures protecting online consumers. These measures prohibit misleading, fraudulent and deceptive commercial practices. Suppliers must act in good faith and follow fair commercial practices. It also provides that sellers must provide clear information about their identity, contact details, product characteristics, and the full price, including all charges, including when operating through intermediary platforms. Consumers must have access to redress and remedies if goods or services paid for are not delivered as agreed. The provisions also require ensuring product safety during normal or reasonably foreseeable use and encourage cooperation between consumer protection authorities to strengthen enforcement.
