On 26 January 2026, the European Commission designated messaging service WhatsApp as a Very Large Online Platform (VLOP) because it found that its “Channels” feature reached the designation threshold of at least 45 million EU users under the Digital Services Act (DSA). The Commission noted that WhatsApp is a hybrid service, comprised of private messaging and an online platform. Its Channels feature allows recipients to disseminate information to a broad audience, which means that it is already subject to DSA obligations for online platforms. The Commission highlighted that WhatsApp's private messaging service, which enables users to send messages, audio and visual content, as well as make voice and video calls, remains outside of the DSA scope. The designation subjects the platform to the DSA's additional obligations. By mid-May 2026, WhatsApp is required to implement measures for user empowerment and protection, including assessing and mitigating systemic risks, such as violations of fundamental human rights and freedom of expression, electoral manipulation, dissemination of illegal content, and privacy concerns. The Commission, in cooperation with the Irish Media Commission, which is the competent digital services coordinator, will oversee WhatsApp's compliance with general and additional obligations for VLOP.
