Data protection authority issued notice highlighting risks arising from TikTok’s international data transfers

On 8 January 2026, the Liechtenstein Data Protection Authority (DSS), issued a notice informing users that TikTok continues to transfer personal data to China and other third countries, and making recommendations to both uses and organisations. DSS stated that TikTok was conducting the transfers despite a joint supervisory decision by European data protection authorities finding them unlawful under the General Data Protection Regulation (GDPR). TikTok has appealed the decision before an Irish court, which temporarily suspended enforcement measures, notably the order to halt data transfers, though the underlying findings of the data protection authorities remain valid. DSS highlighted that TikTok is required to continue displaying a warning notification. At the same time, DSS recommended that users take additional precautionary measures and that organisations identify and clearly communicate the risks arising from continued use of TikTok.
