On 5 January 2026, the Bill prohibiting the sale of toys with companion chatbots (SB 867) was introduced in the California Senate. The Bill would amend the Business and Professions Code by adding Chapter 22.6.5, instituting a ban on the manufacture, sale, exchange, or possession with intent to sell of toys that incorporate a companion chatbot. Under the proposed legislation, a toy is defined as a product designed or intended for play by children aged 12 years or younger. The term companion chatbot refers to an AI system using a natural language interface to provide adaptive, human-like responses, meeting social needs through anthropomorphic features and sustained relationships. The aim of the policy is to regulate the use of AI in products targeting minors to ensure child safety. This prohibition would remain in effect until 1 January 2031, at which point the Chapter would be scheduled for repeal. The legislation builds upon existing laws that require clear notifications when AI is used in companion chatbot platforms and mandates specific disclosures for minor users (Bill no. SB 243).
