On 18 December 2025, the State Administration for Market Regulation and the State Internet Information Office adopted the Supervision and Management Measures for Online Trading Platforms by Order No. 116, which enter into force on 1 February 2026. The Measures prohibit online platforms from using platform rules to impose unreasonable restrictions on the independent business activities of in-platform operators. Specifically, Article 27 prohibits platforms from forcing operators to participate in promotions, exclusive dealing, or below-cost sales. Article 28 prohibits unreasonable fees and charges, as well as impose discriminatory treatment under the same trading conditions. Finally, Article 29 requires the calculation of liquidated damages to be reasonable. Violations of these provisions are punishable under the provisions of the Electronic Commerce Law, the Anti-Unfair Competition Law, and the Price Law.
