President adopted Order No. 2026-2 relating to the remote marketing of financial services to consumers including user/subject right

On 5 January 2026, the President adopted Order No. 2026-2 relating to the remote marketing of financial services to consumers, implementing EU Directive 2023/2673 on financial services contracts concluded at a distance with the purpose of strengthening user/subject rights. The Order amends the relevant provisions of a range of civil codes to expand the right of withdrawal or renunciation and extend applicable time limits where mandatory information has not been provided. The amendments give effect to the Directive's requirement that consumers should be able to easily exercise their right to withdrawal from distance contracts concluded via online interfaces, as well as further requirements regarding the status of payments made before withdrawal and the need to provide adequate explanations. The Order enters into effect on 19 June 2026.
