On 19 June 2026, Order No. 2026-2 relating to the remote marketing of financial services to consumers enters into force, implementing EU Directive 2023/2673 on financial services contracts concluded at a distance by introducing binding design requirements for online interfaces used to conclude distance contracts. The Order amends the Consumer Code by inserting Article L. 222-16-3, which prohibits financial service professionals from designing online interfaces in a way that includes dark patterns, repeated choice prompts, asymmetrical subscription and cancellation processes, and other interface designs that alter or hinder consumer decision-making. The Order thus implements the Directive's requirement for member states to enact additional protections in relation to design features of online interfaces.
